# Terms of Service

These terms are an agreement between you and TraceTail ("we", "us") for using the TraceTail website, API and browser SDK (together, the "Service"). If you use the Service on behalf of an organization, you accept these terms for that organization. If you don't agree to them, don't use the Service.

## 1. The Service

TraceTail's browser SDK computes a visitor ID from characteristics of a visitor's browser. When you use it with your API key, each identification is registered with TraceTail, checked for signs of browser automation and counted in your dashboard. Visitor IDs are a statistical signal: we don't guarantee that every identification is correct.

## 2. Your account

Give accurate information when you sign up and keep access to your email account secure, because that's how you sign in. You're responsible for activity under your account. Tell us at <support@tracetail.io> straight away if you believe someone else has accessed it.

## 3. API keys

API keys are public by design: they appear in your web pages. Each key only works on the domains you register for it, so register only domains you control. You're responsible for the requests made with your keys.

## 4. Your responsibilities to your visitors

For the visitor data the Service processes for you, you are the controller. You must:

- have a legal basis for identifying your visitors and tell them about it, for example in your privacy policy;
- obtain any consent the law requires where your visitors are, before you identify them;
- handle your visitors' requests to access or delete their data. You can erase a visitor's record from Settings in your dashboard, or with `DELETE /api/visitors/:visitorId` while signed in.

## 5. How we process visitor data for you

We process visitor data only to provide the Service to you, as described in our [Privacy Policy](https://tracetail.io/privacy-policy): the visitor ID, the browser characteristics the SDK collects, the IP address and the user agent. We delete a visitor's record 180 days after their last visit to your site and request logs after 90 days. The providers that process data for us are listed in the Privacy Policy.

## 6. Acceptable use

Don't use the Service to:

- break the law or infringe anyone's rights;
- track people across websites you don't operate, or monitor specific individuals;
- discriminate unlawfully against people based on their device;
- get around rate limits, quotas or domain restrictions, or access other customers' data;
- interfere with or disrupt the Service.

## 7. Fees and billing

Every account gets 1,000 identification requests free each calendar month (UTC). To make more, add a card in Settings; requests beyond the free allowance then cost $0.10 per 1,000 and are billed monthly through Stripe. Without a card, or if a payment fails, requests beyond the free allowance are declined. Current prices are on the [pricing page](https://tracetail.io/pricing). We'll give reasonable advance notice of price changes. Fees already paid aren't refundable, except where the law requires.

## 8. Rate limits

Each API key may make up to 100 requests per second, and we also limit requests per IP address to protect the Service. We may suspend a key whose traffic endangers the Service for other customers.

## 9. Availability and changes

We work to keep the Service available but don't guarantee uninterrupted access or offer a service-level agreement. Current status is on our [status page](https://tracetail.io/status). We may change or remove features; if we discontinue the Service, we'll give reasonable advance notice.

## 10. Ownership

The browser SDK's code is published under the MIT License, which governs your use of that code. We own the rest of the Service, including the API, the dashboard and the website. You keep ownership of your data. If you send us feedback, we may use it without obligation to you.

## 11. Disclaimers

To the extent the law allows, the Service is provided "as is" and "as available", without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't warrant that any individual identification is correct or that the Service will prevent fraud.

## 12. Limitation of liability

To the extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months before the claim.

## 13. Indemnity

You'll defend and indemnify us against claims arising from your use of the Service or your breach of these terms, including failing to give your visitors the notice or obtain the consent the law requires.

## 14. Ending the agreement

You can stop using the Service at any time and delete your account from Settings. We may suspend or end your access if you breach these terms. Fees for usage before the end remain due.

## 15. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Before starting a formal dispute, contact us at <support@tracetail.io> so we can try to resolve it informally.

## 16. General

These terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part of these terms is unenforceable, the rest stays in effect. Not enforcing a provision isn't a waiver of it. We may update these terms by posting a new version here with a new date; continuing to use the Service after that means you accept the update.
